# Terms and Conditions – Titan Connect WhatsApp Business API Platform

By accessing or using the Titan Connect WhatsApp Business API Platform ("Platform", "Service", "we", "our", or "us"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please do not use our services.
## 1. Service Description
Titan Connect provides WhatsApp Business API solutions that enable businesses to communicate with customers through WhatsApp. Our services include, but are not limited to:
* WhatsApp Business API integration
* Bulk messaging and campaign management
* Automated messaging and chatbots
* Contact and lead management
* Template message management
* Analytics and reporting
* Third-party integrations
## 2. Account Registration
To use our services, you must:
* Provide accurate, complete, and up-to-date business information.
* Maintain the confidentiality of your login credentials.
* Be at least 18 years of age or legally authorized to represent your business.
* Be responsible for all activities conducted through your account.
## 3. Acceptable Use Policy
You agree to use Titan Connect responsibly and in compliance with applicable laws.
You must:
* Follow all applicable WhatsApp Business Platform Policies and Meta Platform Terms.
* Obtain valid customer consent before sending WhatsApp messages.
* Comply with all applicable Indian laws, including TRAI regulations where applicable.
* Use the platform only for legitimate business communications.
You must not:
* Send spam, unsolicited, misleading, or fraudulent messages.
* Promote illegal, harmful, or prohibited products or services.
* Attempt to misuse, disrupt, or gain unauthorized access to the platform.
* Violate intellectual property or privacy rights.
## 4. Payment Terms
* Subscription plans are billed monthly or annually, depending on your selected plan.
* All prices are in Indian Rupees (INR) unless otherwise specified.
* Applicable GST and taxes will be charged separately.
* Payments are due in advance.
* Fees are non-refundable except where required under our Refund Policy or applicable law.
## 5. Data Privacy
Your privacy is important to us.
* Your use of the platform is governed by our Privacy Policy.
* We process customer data in accordance with applicable Indian data protection laws.
* We implement reasonable security measures to protect your information.
* You remain the owner of your business and customer data.
## 6. Service Availability
We aim to provide reliable and uninterrupted service.
* We target an uptime of 99.9%, but uninterrupted availability cannot be guaranteed.
* Temporary interruptions may occur due to maintenance, network issues, Meta platform changes, or circumstances beyond our control.
* Titan Connect is not responsible for downtime caused by third-party providers, including Meta, internet service providers, or cloud infrastructure partners.
## 7. Limitation of Liability
To the maximum extent permitted by law:
* Titan Connect shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
* We are not responsible for business losses, lost profits, data loss, or interruption caused by third-party services or policy changes made by Meta or WhatsApp.
* Our total liability shall not exceed the amount paid by you for the services during the three (3) months preceding the claim.
## 8. Account Suspension and Termination
We reserve the right to suspend or terminate your account if:
* You violate these Terms and Conditions.
* You breach WhatsApp or Meta policies.
* Your activities are unlawful, fraudulent, or harmful.
* Required payments remain overdue.
You may cancel your subscription at any time through your dashboard or by contacting our support team. Cancellation will take effect according to your current billing cycle.
## 9. Changes to These Terms
Titan Connect may update these Terms and Conditions from time to time. Continued use of the platform after any updates constitutes acceptance of the revised terms.
## 10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the registered office of Titan Connect.
